Carrying Concealed Weapons - Observation of a bulge resembling a pistol supports a Terry stop.
Where the police observe a bulge in a pocket in the shape of a concealed pistol, the outline or printing through the clothing of a concealed pistol in a waistband, or other similar articulable facts that create reasonable suspicion that the individual is carrying a concealed pistol or a concealed weapon contrary to MCL 750.227, the police have reasonable suspicion of crime afoot that justifies a Terry stop.

Just who are “the people”?

The Second Amendment states that “[a] well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” As both critics and supporters of the amendment recognize, little of that language is particularly straightforward. What is a “well regulated Militia,” and how does that apply to today’s arguments over gun control? What constitutes “Arms,” and when is keeping and bearing them “infringed”?
Amid that morass, one phrase that would seem (at least on the surface) a good deal more intuitive is “the people.” After all, doesn’t the people consist of, well, everyone? The answer is … not exactly. So who exactly are “the people” that may possess firearms in the first place? And how might this play into the court’s future decisions on the Second Amendment?

Supreme Court decision on federal gun law could have implications for Michigan

Michigan has recently passed laws aimed at reducing gun violence, specifically related to extreme risk protection orders, the safe and secure storage act, universal background checks, and prohibition on gun ownership or possession for eight years for people convicted of domestic violence offenses.

Supreme Court rejects challenge to Maryland 'assault weapon' ban

May 20, 2024
The Supreme Court on Monday declined to hear a challenge to a gun law in Maryland that bans assault-style weapons such as the AR-15 semiautomatic rifle, which has been used in various high-profile mass shootings.
The decision not to hear the case for now leaves the ban in place in the state. Litigation over the ban and similar laws enacted by other states is ongoing and the issue is likely to return to the justices. The court has an appeal pending concerning a similar law in Illinois.

New laws exempt gun locks, safes and cases from state sales tax

Gun locks, safes and some cases are now less expensive in Michigan.
On Monday, two laws exempt these devices from Michigan’s 6% sales tax. These tax exemptions will remain in effect until December 31, 2024.

MI appeals court rejects challenge to concealed gun law

April 29, 2024

The Michigan Court of Appeals has rejected a constitutional challenge to the state’s concealed weapons law. The opinion was made public Friday.

A defendant was charged with carrying a concealed weapon without a permit as a passenger in a vehicle. Her lawyer argued that Michigan’s concealed weapons law is not consistent with the nation’s historical traditions of gun regulation at the time the Bill of Rights was adopted.

Michigan to offer free gun locks

April 15, 2024

Michigan to offer free gun locks to help owners comply with new secure storage laws

The program, announced Friday by the Michigan State Police and the Michigan Department of Health and Human Services, includes 75,000 cable-style gun locks that are now available at county MDHHS offices and some local health departments. All MDHHS offices should have gun locks available no later than June.

Few guns confiscated in first months of ‘red flag’ law

April 12, 2024

Under the new law, police officers, family members and mental health professionals can go to a circuit court judge and ask for an extreme risk protection order (ERPO). A judge can then order police to temporarily take away someone’s guns if the petitioner shows specific examples of why the person is a threat. That can include prior acts or threats of violence, a serious history of mental illness or recent drug or alcohol abuse.

It’s aimed to keep guns out of the hands of people deemed to be dangerous
